Three teenagers from Tennessee have filed a class action lawsuit against Elon Musk's xAI, claiming that the company's Grok AI chatbot generated sexually explicit images and videos of them as minors. The lawsuit, filed in California, alleges that Grok produced child sexual abuse material (CSAM) using real images of the plaintiffs when they were underage. The plaintiffs include two minors and an adult who was a minor at the time of the incidents. One of the plaintiffs, identified as "Jane Doe 1," reported discovering explicit AI-generated images of herself and other minors being shared on platforms like Discord and Telegram, allegedly used as a bartering tool for other CSAM. The lawsuit accuses Musk and other leaders of xAI of being aware that Grok would produce such content when it launched its "spicy mode" last year. The plaintiffs are seeking to represent anyone whose images were altered into sexual content by Grok. The lawsuit claims that the images and videos were created in familiar settings but morphed into sexually explicit poses, causing the plaintiffs severe emotional distress. xAI is already facing multiple investigations globally regarding reports of Grok generating sexualized images of children. Governments and regulators have begun to impose bans and demand safeguards to curb the proliferation of illegal and offensive material associated with the AI technology. The lawsuit highlights the ongoing concerns about the ethical implications of AI-generated content and the responsibilities of companies like xAI in preventing the misuse of their technologies.
